1. Acceptance of Terms

By registering for or using Fictish, you agree to comply with these Terms of Use, our Privacy Policy, and any other guidelines or policies posted on the site.

2. Eligibility

Fictish is intended for users who are at least 13 years old. By using this site, you represent and warrant that you meet this requirement.

3. User Accounts

To access certain features of Fictish, you must create an account. You are responsible for maintaining the confidentiality of your login information and for all activities that occur under your account.

4. User-Generated Content

Fictish allows users to upload, publish, and share fiction writing as well as feedback and comments to said writing ("Content"). By submitting Content, you:

  • Grant Fictish a non-exclusive, royalty-free, worldwide license to use, display, reproduce, and distribute your Content on the platform.
  • Warrant that you own or have the necessary rights to all Content you upload.

5. Prohibited Content

You may not post or share any Content that:

  • Contains offensive, obscene, or explicit material.
  • Promotes hatred, violence, discrimination, or illegal activities.
  • Contains strong or extreme political themes that may be deemed offensive.
  • Violates any copyright, trademark, privacy, or other proprietary rights of any third party.
  • Includes malware, phishing links, or other harmful technologies.

Fictish reserves the right to remove Content that violates these rules or is deemed inappropriate at our sole discretion.

6. Content Moderation

While Fictish does not pre-screen all submissions, we reserve the right to monitor, edit, or remove Content that violates these Terms or that we find objectionable for any reason.

7. Intellectual Property and Content Ownership

All Content submitted by users remains their property. However, the overall design, branding, and functionality of the Fictish platform are the exclusive property of Fictish.

Writers retain full ownership of the content they write. By posting on Fictish, you grant us a license to display your content on the platform, but the rights to your work remain yours.

Please be informed that under no circumstance does Fictish have any intention of selling content submitted.

8. Prohibited Automated Access

You may not use any robot, scraper, crawler, or other automated means to access the Fictish platform for any purpose without our express written consent. This includes, but is not limited to, extracting data, circumventing security measures, or interfering with the functionality of the platform. Any unauthorized use of automated tools will result in immediate termination of access.

9. Termination of Access

Fictish reserves the right to suspend or terminate your account or access to the platform for violating these Terms or engaging in any activity that harms the community.

10. Limitation of Liability

Fictish is provided on an "as is" basis. We do not guarantee the accuracy, reliability, or availability of the platform and will not be liable for any damages arising from your use of the site.

11. Changes to Terms

Fictish may update these Terms of Use from time to time. Continued use of the platform after such changes indicates your acceptance of the revised terms.

12. Competitions

From time to time, we may run competitions, contests, giveaways, or similar promotional activities (“Competitions”). By participating in any Competition, you agree to the following:

  • All matters relating to Competitions, including but not limited to eligibility, judging criteria, selection of winners, and awarding of prizes, are determined solely by us, in our absolute discretion.
  • Our decisions are final and binding, and no correspondence, appeals, or disputes will be entered into.
  • We reserve the right, at any time and for any reason, to modify, suspend, or cancel a Competition, or to withhold or substitute any prize, without liability.
  • We may also disqualify any participant who we reasonably believe has violated these Terms of Use, engaged in unfair practices, or otherwise acted in bad faith.
  • Participation in a Competition does not guarantee winning or receipt of any prize.
  • We make no representation or warranty regarding the nature, value, or quality of any prize. All prizes are provided “as is” without warranty of any kind.
  • Competitions may be subject to additional rules, eligibility requirements, or restrictions (for example, age or jurisdictional limitations).
  • By participating, you represent and warrant that you meet all applicable requirements.
  • It is your responsibility to ensure your participation complies with all applicable laws in your jurisdiction.
  • Each participant is eligible to win only one (1) prize per Competition, regardless of the number of entries submitted. We reserve the right to disqualify or revoke prizes if multiple entries or wins are determined to violate this rule.
  • To the fullest extent permitted by law, you release and hold harmless us, our affiliates, employees, officers, and partners from any and all claims, demands, damages, or causes of action arising out of or relating to your participation in any Competition or the acceptance, use, or misuse of any prize.
  • We are not responsible for technical failures, lost entries, delays, or any other issues beyond our reasonable control.
